Terms of Use

1. Scope & Contracting Party
These Terms of Use (hereinafter "Terms") apply to the use of the mobile application SkyjoScore (hereinafter "App") as well as the associated website at SkyjoScore.app. The provider and contracting party is:

By downloading, installing, or using the App, you agree to these Terms of Use. If you do not agree, you may not use the App and are asked to uninstall it.
These Terms apply exclusively. Conflicting or deviating terms of the user are not recognised.
2. Minimum Age
Use of the App requires a minimum age of 13 years. Users under 16 years of age require the consent of a parent or legal guardian to create an account and to give consent to data processing, in accordance with Art. 8 GDPR.
By using the App, you confirm that you have reached the minimum age of 13 and (if you are between 13 and 15 years old) that a legal guardian has approved your use and consent to data processing.
3. Description of Services
SkyjoScore is a score-tracking app for the Skyjo card game. The App allows you to record game rounds, track scores, and determine winners. SkyjoScore is not affiliated with Magilano or the makers of Skyjo and is not an official product of Magilano.
Guest Use (Without Registration)
The App can be used without registration. Game data created in guest mode is kept exclusively in the device's memory and is irretrievably deleted when the App is closed. There is no entitlement to data persistence. Up to 3 games can be managed simultaneously.
Free Account (Basic)
After free registration, up to 3 games can be permanently stored on our servers. Registration requires a valid email address and a username.
Premium Subscription
For a fee, a premium subscription can be purchased. Premium users receive unlimited game storage. Payments are processed exclusively via the Apple App Store; Apple's payment and subscription terms additionally apply.
Availability
We strive to keep the App continuously available, but do not guarantee uninterrupted availability. Maintenance work, technical disruptions, or force majeure may lead to temporary outages. There is no claim to permanent availability.
4. Registration & Account
The following details are required for registration:
- Valid email address
- Secure password (at least 8 characters)
A username can be set optionally. You are obliged to provide truthful information and to keep your access data confidential. In the event of unauthorised use of your account by third parties, you are obliged to notify us immediately.
Only one account is permitted per person. Transferring or sharing accounts is prohibited.
Account Closure / Data Deletion
You can have your account deleted at any time. To do so, send an informal email with the subject "Account deletion" and the email address registered with the account to: contact@skyjoscore.app. Your account and all associated data will be completely deleted within 30 days. Recovery is not possible after that.
We reserve the right to suspend or delete accounts that violate these Terms of Use.
5. Premium Subscription, Prices & Right of Withdrawal
Conclusion and Billing
The premium subscription is purchased via the Apple App Store. The purchase contract is concluded with Apple as a commercial agent. Billing takes place at the prices and conditions displayed at the time of purchase via your Apple ID account. Price changes will be communicated in due time in the App and in the App Store.
Cancellation
You can cancel the premium subscription at any time at the end of the current billing period. Cancellation is done exclusively via the Apple App Store settings:
- iOS: Settings → [Your Name] → Subscriptions → SkyjoScore
After cancellation, you retain access to the premium features until the end of the paid period. A refund of proportional fees for unused periods is excluded unless otherwise required by law.
Right of Withdrawal (Consumers)
As a consumer (§ 13 BGB), you generally have a statutory right of withdrawal pursuant to § 355 BGB. Since an app subscription is digital content that is provided immediately after purchase completion and your express consent to immediate execution, the right of withdrawal expires pursuant to § 356(5) BGB upon commencement of contract performance.
Otherwise, the withdrawal of a purchase concluded via the Apple App Store is governed by Apple's withdrawal policies. Refund requests must be directed to Apple: reportaproblem.apple.com.
6. Voluntary Support (Rewarded Ads)
The App shows no embedded advertising (no banners, no interstitials). However, you can voluntarily support the development of the App by tapping the "Support" button to watch a short rewarded ad. An ad is loaded only after your explicit tap action.
Rewarded ads are delivered via Google AdMob (Google LLC, USA). Premium users do not see the "Support" button. Before an ad is loaded, we obtain your consent. You can adjust or withdraw your consent at any time under Settings → Privacy options. Detailed information on data processing by AdMob can be found in our Privacy Policy, Section 6.
7. User Obligations & Prohibited Actions
You undertake to use the App exclusively for private, non-commercial purposes and in accordance with these Terms as well as applicable laws. In particular, the following is prohibited:
- Copying, decompiling, modifying, reverse-engineering the App or using it in derivative works
- Circumventing security mechanisms, protection systems, or access restrictions of the App
- Performing automated access (bots, scrapers, crawlers) to backend services of the App
- Using the App for unlawful purposes or to harass other persons
- Using false identities or third-party accounts
- Reselling the App commercially or making it available to third parties for a fee
8. Privacy
The processing of personal data takes place in accordance with our Privacy Policy, which is part of these Terms of Use. By using the App, you acknowledge this Privacy Policy.
9. Disclaimer of Liability
The App is provided "as is" and "as available". We do not guarantee uninterrupted availability, complete freedom from errors, or protection against data loss.
Our liability for damages is excluded (as far as legally permissible), unless it concerns:
- Damages from injury to life, body, or health
- Damages caused by intent or gross negligence on our part
- Damages based on the violation of essential contractual obligations (cardinal duties)
We accept no liability for the content of linked external websites (in particular Google, Apple, Supabase). Liability for data loss is limited to the typical recovery effort that would also have occurred with regular and risk-appropriate backup copies.
10. Intellectual Property
All rights to the App, its design, its code, the name "SkyjoScore", and the associated logo belong to the provider, unless otherwise stated. No right to permanent use is granted; use takes place on the basis of a revocable, non-transferable, non-sublicensable licence.
"Skyjo" is a registered trademark of Magilano GmbH & Co. KG. SkyjoScore is an independent product without licensing by Magilano. Any use of third-party trademarks in the App is for descriptive reference only.
11. Changes to the Terms of Use
We reserve the right to change these Terms of Use at any time. Material changes will be announced at least 30 days before they take effect in the App and/or by email to registered users.
If a registered user does not object to the changed Terms within 30 days of notification, the changes are deemed accepted. The right of objection and its consequences will be specifically pointed out in the change notification.
For guest users (without account), the current version of the Terms available on this website applies.
12. Applicable Law & Jurisdiction
The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods (CISG).
The place of jurisdiction for all disputes arising from or in connection with these Terms of Use is (provided you are a merchant, a legal entity under public law, or a special fund under public law) the registered office of the provider. The statutory places of jurisdiction apply to consumers.
The European Commission provides a platform for online dispute resolution (ODR): ec.europa.eu/consumers/odr. We are not willing or obliged to participate in dispute resolution proceedings before a consumer arbitration board unless required by law.
13. Severability Clause
Should individual provisions of these Terms of Use be or become invalid or unenforceable in whole or in part, this does not affect the validity of the remaining provisions. The invalid provision shall be replaced by a valid one that comes closest to the economic purpose of the invalid one.
